European Collections - Loyalty Contest

1.

Eligibility

(a)

The contest is conducted by Van Houtte Ltd./Ltée (hereinafter referred to as “Van Houtte”) and is open to anyone who has reached the age of majority in the state or province in which they reside.

(b)

You are not eligible to enter if you are:

 

(i)

an employee, agent or franchisee of Van Houtte, any of its affiliates, subsidiaries, franchisees, advertising or promotional agencies, assignees, printing suppliers, licensees or the prize suppliers; or

 

(ii)

a member of the immediate family or a member of the household of any of the above persons. In these rules, “immediate family” means spouse, children, siblings, parents and their spouses.

 

2.

How to Participate

(a)

The contest begins January 27th, 2004 and ends May 30th 2004 at 11:59 pm, EDT. No purchase is necessary to enter.

(b)

Participation tickets for the draw are bought using the points accumulated in the Van Houtte "European Collections"and "Loyalty"programs. Each tickets costs 100 points in either of the above programs.

(c)

To be valid, the tickets must have been exchanged before May 30th 2004 at 11:59 pm, EDT.

 

3.

Prize

(a)

An electronic random draw will take place on May 31, 2004 at 3 p.m. (EDT) and at the head office of Van Houtte, 8300-19th Ave., Montreal (Quebec) H1Z 4J8. The odds of being selected will depend on the total number of eligible entries received. The selected entrant will be contacted within ten days of the draw date by telephone or email. If a selected winner cannot be contacted within that time or does not comply with the contest rules, the prize will be forfeited and an alternative eligible entry will randomly be drawn.

(b)

Prizes: Two (2) Saeco Espresso Coffeemakers, valued at $500 each, ten (10) 'European Expressions' Gift Baskets, valued at $25 each, and ten (10) Taste Tantalizer Gift Baskets, valued at $23 each, for a total value of $1480.

(c)

The prize must be accepted as awarded and is not transferable or convertible to cash.

(d)

At its election, for any reason whatsoever, Van Houtte may substitute a prize of equivalent value.

(e)

The prize winner may be requested to swear an affidavit indicating eligibility and compliance with the contest rules.

 

4.

Conditions of Participation

 

By participating in this contest, participants agree:

(a)

to be bound by these official contest rules and the decisions of Van Houtte, whose decisions shall be final;

(b)

to the use of their name, likeness, voice, photograph, video footage and/or statements for promotional and advertising purposes without compensation;

(c)

to sign a publicity release acknowledging the rights of Van Houtte or its agents to publish or broadcast the winner’s picture, name, likeness, voice, photograph, video footage and/or statements for publicity purposes, without compensation other than the value of the prize offered;

(d)

to sign a standard release form releasing Van Houtte, its franchisees, advertising and promotional agencies, the prize suppliers, the affiliates of the foregoing and all of their respective employees, directors, officers, owners, partners, agents, representatives, successors, and assigns from any liability in connection with or arising out of this contest, the awarding of the prize, the use of any personal information or the use of merchandise purchased in relation to winning a prize;

(e)

to return executed declaration and release documents within three (3) business days of the date of receipt by the winner.

 

 

5.

Van Houtte assumes no responsibility for network connection problems, unsuccessful transmissions, problems with the Internet network, hardware problems, software problems, or other computer or technical malfunctions as well as for any communication errors or situations that affect, disturb, or alter the contest in any way whatsoever, including but not limited to, the reception of tickets, eligibility to the contest, the transmission of the notice to the winning participant, his response to this notice, or related to any damages caused to the participant’s computer following participation in this contest or from downloading the information required to participate in it.

 

 

6.

Van Houtte reserves the right, in its sole discretion, to cancel or suspend this contest should a virus, bug, or other cause beyond the reasonable control of Van Houtte corrupt the security or proper administration of this contest.

 

 

7.

This contest is subject to all applicable federal, provincial and municipal laws and is void where prohibited.

 

Quebec Residents
In Quebec, any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
